Terms of Use

By creating an account, accessing or using the TrackAPI platform, you fully agree to these Terms of Use. If you are using TrackAPI on behalf of a company, you represent that you have the authority to bind that company to these terms.

If you do not agree with any part of these terms, do not use the platform.

TrackAPI is a server-side tracking SaaS (Software as a Service) platform that enables the capture and forwarding of conversion events to ad platforms (Meta Conversions API, TikTok Events API and Google Analytics 4 Measurement Protocol), using CNAME first-party on the customer's domain.

Services include:
- Conversion event processing via Cloudflare Workers
- Dashboard for project and integration management
- JavaScript SDK and GTM templates for installation
- Tracking quality reports (Event Match Quality Score)

To use TrackAPI, you must:

- Be at least 18 years old or the legal age of majority in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Not reside in a country subject to embargo or international sanctions that would prevent use of the service
- Use the service exclusively for lawful purposes and in compliance with all applicable laws

By creating an account, you agree to:

- Provide true, accurate and complete information at registration
- Keep your account information up to date
- Maintain the confidentiality of your access credentials
- Notify TrackAPI immediately of any unauthorized access to your account
- Be responsible for all activities performed under your account

TrackAPI reserves the right to refuse registrations or terminate accounts at its discretion, especially in cases of violation of these terms.

Available plans
TrackAPI offers different subscription plans with monthly event limits. Current plans and pricing are available on the pricing page at trackapi.app.br.

Billing
Billing is performed monthly or annually, depending on the chosen plan, via credit card processed by Stripe. By providing payment details, you authorize recurring charges.

Automatic renewal
Subscriptions automatically renew at the end of each period, unless cancelled at least 24 hours in advance.

Upgrades and Downgrades
Upgrades take effect immediately with prorated billing. Downgrades are applied in the next billing cycle.

Refunds
We do not provide partial or full refunds for periods already used, except as required by law. In case of erroneous billing, contact us at contato@trackapi.app.br.

Non-payment
In case of payment failure, service may be suspended after notification. Data is retained for 30 days before permanent deletion.

By using TrackAPI, you agree NOT to:

- Use the service for illegal, fraudulent activities or those that violate the rights of third parties
- Collect or transmit personal data without the appropriate consent of data subjects
- Attempt to access unauthorized systems or data
- Reverse engineer, decompile or attempt to extract the platform's source code
- Sell, resell or sublicense the service without express authorization
- Use the service in a way that causes damage, overload or degradation of the infrastructure
- Transmit credit card data, passwords or financial information directly via events
- Violate the Terms of Service of integrated ad platforms (Meta, TikTok, Google)

Non-compliance may result in immediate account suspension without right to a refund.

Use of TrackAPI involves processing personal data of visitors to our customers' websites. In this relationship:

- The customer (you) is the Controller of your visitors' data
- TrackAPI acts as a Processor, handling data according to your instructions

You are responsible for:
- Obtaining appropriate consent from your visitors
- Informing them about the use of tracking in your Privacy Policy
- Complying with LGPD, GDPR and other applicable laws for your business
- Configuring TrackAPI in a manner consistent with your legal documents

All content, code, design, trademarks and technology of the TrackAPI platform are the exclusive property of Speltech or its licensors, protected by intellectual property laws.

You receive a limited, non-exclusive, non-transferable and revocable license to use the service in accordance with these terms. No intellectual property rights are transferred to the user.

Data and configurations you enter into the platform remain your property. TrackAPI does not claim ownership over your data.

We strive to keep the service available 24/7, but we do not guarantee uninterrupted availability. Interruptions may occur due to:

- Scheduled maintenance (with prior notice whenever possible)
- Third-party infrastructure failures (Cloudflare, Vercel)
- Security incidents or force majeure

We do not offer a formal SLA (Service Level Agreement) for Free and Pro plans. Business and Enterprise plans may negotiate SLA terms directly with our team.

To the maximum extent permitted by law:

- TrackAPI is provided "as is", without express or implied warranties
- We do not guarantee that the service will be error-free, uninterrupted or that it will meet all your specific requirements
- We are not responsible for indirect, incidental, special or consequential losses, including loss of revenue, data or business opportunities
- Our total liability in any case is limited to the amount paid for services in the last 3 months

Nothing in these terms limits our liability in cases of willful misconduct, fraud or violations that cannot be excluded by law.

By you: You may cancel your account at any time through the Dashboard or by emailing contato@trackapi.app.br. Access continues until the end of the paid period.

By us: We may suspend or terminate your account immediately in case of serious violation of these terms, without right to a refund. For minor violations, we will provide prior notice with a deadline for correction.

Effects of termination: After closure, your data will be retained for 30 days for possible recovery, after which it will be permanently deleted.

We may update these Terms of Use at any time. Significant changes will be communicated at least 30 days in advance by email or notice in the Dashboard.

Continued use of the service after changes take effect constitutes acceptance of the new terms. If you do not agree, you may close your account before the effective date.

These Terms are governed by the laws of the Federative Republic of Brazil. For dispute resolution, the jurisdiction of the city of Curitiba, State of Paraná, is elected, with express waiver of any other, however privileged.

Before any legal action, the parties agree to attempt to resolve the dispute amicably within 30 days.
